Terms of Service

1. Agreement to Terms

By accessing or using the Kimodo application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you and Algolab Limited, a company registered in Tanzania with its principal place of business at No. 2 Old Bagamoyo Rd. Mbezi Beach, Kawe, Dar es Salaam, Tanzania.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract with Algolab Limited and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Service.

3. Use License

Subject to your compliance with these Terms, Algolab Limited grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal or commercial use.

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right
• Interfere with security-related features of the Service
• Attempt to access any portion of the Service that you are restricted from accessing
• Use the Service to generate content that is harmful, offensive, or inappropriate

4. User Content and Intellectual Property

Your Content: You retain all rights, title, and interest in and to the images and content you upload to the Service ("User Content"). By uploading User Content, you grant Algolab Limited a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content solely for the purpose of providing the Service to you.

Generated Content: The images generated by our AI using your User Content and our model library are owned by you. You may use these generated images for any lawful commercial or personal purpose.

Our Content: The Service, including its design, features, functionality, and the model library, is owned by Algolab Limited and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.

5. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALGOLAB LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Dar es Salaam, Tanzania.
